Terms & Conditions

1. introduction

1.1 These Terms and Conditions (“Terms”) govern all professional services, transactions, and engagements between Prestigious Business Consulting Sdn. Bhd. (Company No. 1151971W / 201501026647) (collectively referred to as “Prestigious,” “we,” “our,” or “us”) and the client (“Client,” “you,” or “your”).

1.2 By engaging Prestigious or accessing our website, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to any part of these Terms, you should not proceed with our services.

2. Definitions

2.1 “Services” means all professional consultancy, administrative, and support services provided by Prestigious, including but not limited to:

  • Immigration & Expatriate Management;
  • Licensing (WRT, MIDA, MOTAC, FINAS, etc.);
  • Payroll & Employer of Record (EOR) services;
  • and related advisory services.

2.2 “Client” refers to any individual, company, or organisation that engages Prestigious for professional services.

3. Scope of Services

3.1 Prestigious provides end-to-end consultancy, documentation, and coordination services in connection with immigration, licensing, and regulatory compliance matters in Malaysia.

3.2 Prestigious does not guarantee approval of applications submitted to government authorities, as final decisions rest solely with the respective agencies.

3.3 Any advice, documentation, or assistance rendered by Prestigious is based on the accuracy and completeness of information provided by the Client

4. Fees and payment terms

4.1 All fees and charges are specified in our quotation, proposal, or invoice.

4.2 Unless otherwise stated, fees are exclusive of applicable taxes (e.g., SST).

4.3 Payment terms are as follows:

  • 50% deposit upon confirmation of engagement; and

  • 50% balance upon completion of the service or upon mutual agreement.

4.4 Payments must be made to the company account stated on the invoice.

4.5 All professional fees are non-refundable once services have commenced, regardless of the application outcome or any external delays beyond our control.

4.6 Authority fees or government charges are subject to change as determined by the relevant authorities.

4.7 Prestigious reserves the right to withhold or suspend services if payment is not received according to agreed terms.

5. Confidentiality and data protection

5.1 Prestigious is committed to maintaining the confidentiality of all information provided by the Client and shall process personal data in accordance with the Personal Data Protection Act 2010 (PDPA) and our Personal Data Protection Policy, available at https://www.prestigious.my/privacy-policy.

5.2 Information may be disclosed to authorised government departments, embassies, and service providers strictly for the purpose of fulfilling service obligations.

6. Client Responsibilities

6.1 The Client shall provide complete and accurate documentation and information necessary to process any application or service request.

6.2 Prestigious shall not be held responsible for any delay, rejection, or penalty arising from incomplete, false, or late submission of information by the Client.

6.3 The Client is responsible for verifying all documentation and ensuring compliance with the relevant laws and regulations of Malaysia.

7. Limitation of Liability

7.1 Prestigious shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services.

7.2 The maximum liability of Prestigious, if any, shall not exceed the total professional fee paid for the specific service rendered.

7.3 Prestigious shall not be liable for delays, rejections, or decisions made by government agencies, as these are beyond our control.

8. Termination

8.1 Either party may terminate an engagement in writing, provided that all outstanding fees and disbursements incurred up to the date of termination are duly settled.

8.2 Prestigious reserves the right to terminate services immediately if:

  • The Client fails to make timely payment;

  • The Client provides false or misleading information; or

  • The Client’s conduct affects Prestigious’s professional integrity or violates Malaysian law.

9. Force Majeure

9.1 Prestigious shall not be held liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from events beyond its reasonable control, including but not limited to:

  • Government delays or system outages;

  • Acts of God, natural disasters, or pandemics;

  • Technical or operational disruptions; or

  • Other unforeseen circumstances preventing timely execution.

9.2 In such cases, Prestigious shall notify the Client and make reasonable efforts to resume operations promptly.

10. Governing Law and juridiction

10.1 These Terms shall be governed by and construed in accordance with the laws of Malaysia.

10.2 Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of  Malaysia.

11. entire agreement and Updates

11.1 These Terms constitute the entire agreement between Prestigious and the Client and supersede any prior verbal or written agreements.

11.2 Prestigious reserves the right to amend or update these Terms at any time.
