Cancellation And Refund Policy on Service
1. Eligibility
- 1.1. A Client shall be eligible to request a refund of service fees only where all the following cumulative conditions are satisfied:
- a. A written request for cancellation is received by Prestigious within twenty-four (24) hours of the date and time of payment confirmation;
- b. No portion of the professional service has been rendered, delivered, or otherwise initiated;
- c. Prestigious has not commenced any form of preparatory work in relation to the engagement; and
- d. The service in question does not involve or include disbursement of any third-party, regulatory, statutory, or governmental fees.
- 1.2. For the purposes of this Policy, “preparatory work” shall include, but is not limited to:
- The review, handling, or processing of documentation;
- Any internal planning, research, or advisory work;
- Communication initiated with the Client or third-party stakeholders; or
- Allocation of internal resources, administrative setup, or preliminary drafting of materials.
- 1.3. A refund shall not be granted under any of the following circumstances:
- a. Where the service has been rendered in whole or in part;
- b. Where preparatory work has commenced, regardless of its completion status;
- c. Where cancellation is requested due to change of mind, dissatisfaction with service suitability, or client-side delay or non-compliance;
- d. Where the Client has failed to provide requisite documentation or information within a reasonable time;
- e. Where non-refundable authority or third-party fees have been paid.
- 1.4. Without prejudice to the foregoing provisions, where the Client places an order for any regulatory, licensing, or immigration-related service (including but not limited to employment pass applications, residence pass–talent, CIDB licensing, or any other government-regulated submission), and subsequently elects to cancel the order, the following terms shall apply.
a) Where No Work Has Commenced:
- i. A full refund of the fees paid (excluding any disbursed government or authority fees) shall be granted if the refund request is submitted within six (6) calendar months from the date of payment;
- ii. A fifty percent (50%) refund of the service fee shall be granted if the request is submitted after six (6) months but before twelve (12) calendar months from the date of payment;
- iii. After twelve (12) months, no refund shall be issued. The service shall be deemed completed and the fees earned in full.
b) Where Work Has Commenced:
- i. Once any form of work has been initiated, including internal processing, drafting of documents, advisory services, or communication with relevant authorities, the professional fees shall be strictly non-refundable;
- ii. Notwithstanding the foregoing, any government or authority-related fees paid by Prestigious on behalf of the Client may be refunded, but only to the extent that such fees are refundable by the respective authority and have not yet been submitted or utilized.
1.5. Definition of “Commencement of Work”:
- 1.5.1. For the purposes of this Clause, “commencement of work” shall include, without limitation:
- i. The review or processing of client documents;
- ii. Preparation or drafting of any forms, submissions, or letters;
- iii. Advisory or compliance consultation;
- iv. Communication or coordination with government agencies or third parties;
- v. Allocation of internal staff or administrative resources to the Client’s matter.
2. Case-By-Case Evaluation and Contact Information
2.1 All refund requests must be made in writing to finance.department@prestigious.my. Each refund request will be individually evaluated and is subject to our approval.
2.2 Upon evaluation and approval, the refund terms outlined in Clause 1 above will generally be followed. However, we reserve the right to provide refunds on a case-by-case basis.
3. Refund Process and Timing
3.1 Upon approval of your refund request by us, we will issue refund within fourteen (14) business days from the date of approval.
3.2 You acknowledge and agree that when the refund is issued to your payment method, our issuance of a refund receipt serves only as a confirmation that we have initiated the refund to the payment method chosen by you and communicated to us.
3.3 We have no control over the timing of when the refund will be credited to your payment method. You further acknowledge and agree that the payment provider and/or the issuing bank associated with your payment method determine and regulate the timeframes for processing the refund.
4. Policy Updates
4.1. We reserve the right to modify, amend, vary, change, replace and/or update this Policy at any time as we deem fit, without prior notice to you.
